you cant defend a car forcing you to double clutch because else you cant get into first gear.

It can happen with any car, and has happened with pretty much any car I've owned at some point over the last 20 years. If the gear box is stationary (input shaft has stopped spinning) you may not be able to select a gear if the gear faces don't line up. Synro's don't do anything if the gearbox isn't moving! It may only happen 1 in 100 times but you have to understand why it happens.

I can understand it being abit rough to get into gear but it just popping out of first gear if you let go of the clutch is rubbish.

never happened to the MT I drove

It only happens if you don't actually have it in gear.
