Dealer cant reproduce issue; now what?

So I had the dreaded CSC failure where the clutch stuck to the floor. Dealer obviously couldnt reproduce it on the spot so all they did was replace the fluid. If they cant replace it but I know the problem exists, is there anything I can do? I tried telling them that it's a safety issue which of course they laughed at since "you can just coast to a stop". I countered saying any loss of control input with the vehicle is a safety issue, what if I cant move out of the way because I'm stuck on an old country road at night with low visibility and no shoulder? Someone could rear-end me. They just said "we cant replace it if we cant verify it exists".

Great, so until my car full blown breaks down on the highway requiring a tow they wont do squat. Or will they? Is there any way to force their hand? Should I just bring my car in every day claiming the peddle stuck till I annoy them to death? Threaten to talk about the issue with customers while they examine my car? Advice?

simple answer is NO

They won't fix anything until they determine it's broken.

Thats the only way they get paid from the manufacturer

If it's a safety recall then thats a different since the manufacturer is ordering the warranty repair weather its broken or not.

I see you have a 13'

I presume your nearing end of warranty and if totally fails and it's proven by them then it will be covered under the drivetrain warranty otherwise it's out of pocket.

Trips is exactly right. Being a technician myself there is nothing that the dealership nor I can do until the tech verifys the complaint.

Get video of it, and show them the video. That might be the closest thing you can do. Make sure you include some kind of identifying thing to show them that it is the same car that you're bringing to them. Like, show the pedal stuck, and then walk around to the license plate to show them it's your car. Or show them your vin in the video.

Great idea, I like that a lot. As of the moment they replaced the fluid with GTR brake fluid.

Brake fluid is clutch fluid.

To be fair, it could just be your fluid, especially if you're running stock DOT3 and it hasn't been changed before. The CSC failure will result in a permanently dead clutch pedal, not just a temporary loss of pressure. If they do replace it, they are just going to install another plastic stock CSC. If you want a permanent fix, look to the ZSpeed HD CSC or the Z1 CSC Elimination Kit. Either way, that will be an out-of-pocket expense.

i believe there will also be loss of clutch fluid in the process of csc/cmc failure.

if you are nearing the end of warranty then make sure you have them document that you brought it in for this concern and that it was not addressed. This way if it finally permanently fails just out of warranty you can press to have it covered since it wasn't fixed first visit and first visit was in the warranty period.
